These Terms of Service ("Terms") are a contract between Dailytrackly Inc., a Florida corporation ("DailyTrackly," "we," "us"), and the business that uses a DailyTrackly workspace ("Customer," "you"). They govern your access to and use of the DailyTrackly platform, including dailytrackly.com and our web and mobile apps (the "Service").
After your workspace is purchased, an administrator accepts these Terms for your business in the app. By accepting, the administrator confirms they're authorized to bind the business. Everyone who uses your workspace must follow these Terms.
Each business gets its own workspace with a unique address (for example, dailytrackly.com/yourbusiness). You're responsible for keeping account credentials confidential and for all activity in your workspace.
Your administrators control who has access. You're responsible for everyone who uses your workspace, including employees, contractors and agents. Each user confirms DailyTrackly's calling and texting rules before using the Service.
You agree not to:
We may suspend or limit calling, texting or your whole account immediately, and without notice when needed, if we believe there's a legal, carrier or security risk. Examples include carrier complaints or blocking, spam reports, unusual opt-out rates, suspected TCPA or Do Not Call violations, non-payment, or a request from a carrier or government authority. We may cooperate with carriers, our service providers and law enforcement. We may also terminate accounts that violate these Terms.
Some features of the Service (including Lead Hub) allow businesses to send SMS text messages to customers and prospects. DailyTrackly acts as a technology provider that transmits messages on behalf of those businesses.
Privacy details for SMS, including non-sharing of mobile numbers, are described in our Privacy Policy.
When a business that uses DailyTrackly sends you a document to sign electronically, DailyTrackly can text you about it from its own toll-free number, (877) 470-1806.
Built-in calling and softphone features are not a replacement for traditional phone service and do not support emergency calls (including 911). Always use a landline or mobile phone for emergencies.
DailyTrackly is a software platform only. We provide tools that your workspace may use to import contacts and to place calls or send texts. DailyTrackly is not the seller, telemarketer, caller, or "person" making any call or sending any text under the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), FCC or FTC rules, or any state analog.
DailyTrackly does not:
The workspace owner, the account holder, and every user who imports lists or places calls or texts through the Service are solely and exclusively responsible for:
Checking a box, uploading a file, using Power Dial, or any other use of the Service does not mean DailyTrackly performed a DNC check, created consent, or assumed any duty to prevent calls to DNC numbers.
NO LIABILITY FOR DNC CALLS. To the maximum extent permitted by law, DailyTrackly and its owners, officers, directors, employees, contractors, affiliates, and vendors shall have no responsibility and no liability — whether in contract, tort, statute, or otherwise — for any call, text, voicemail, or other outreach placed by you, your account, your workspace, or any user of your account to any number on a National, state, or other Do Not Call list, or for any fine, penalty, damages, lawsuit, class action, investigation, carrier blocking, or other consequence arising from such outreach or from any alleged TCPA, TSR, or state-law violation.
You agree to indemnify, defend, and hold harmless DailyTrackly and the parties named above from and against any claim, demand, investigation, fine, penalty, loss, or lawsuit (including reasonable attorneys' fees) arising out of or related to (a) calling or texting DNC-listed numbers, (b) any alleged TCPA, TSR, DNC, or consent violation, or (c) lists you import or numbers you dial or text using the Service.
Calls placed or received through the Service may be recorded, as your workspace's settings allow. The Service can transcribe and analyze recordings to grade calls and coach your team.
You're responsible for giving every notice and getting every consent the law requires before a call is recorded, including in states that require the consent of everyone on the call, and for training your team to do so.
We record, store, transcribe and analyze calls only on your behalf and at your direction, to provide the Service to you. We don't use your recordings or transcripts to train artificial-intelligence models, and we don't sell them or use them to market to anyone.
Some features use artificial intelligence, including AI-written texts and replies, call grades, coaching and tips. AI output can be wrong or incomplete.
Texts written by AI go out the way your workspace sets them up: some are sent only after someone on your team reviews and chooses to send them, and AI steps you add to a workflow send automatically. Either way, you're responsible for every text sent from your workspace, the same as one your team typed.
AI output isn't legal, compliance, underwriting or insurance advice. To provide an AI feature, we send the information it needs to the AI providers listed in our Privacy Policy.
Your workspace controls its automated texts and workflows, including the first text to new leads: you can edit, pause or turn off each one. We provide starting wording as a convenience; when your workspace uses it, it's your message.
Automated texts are sent on your behalf and at your direction. You're responsible for them like any other text from your workspace, including consent, opt-outs, quiet hours and content.
DailyTrackly is a software company. It isn't an insurance agency, producer, carrier or law firm, and it doesn't give insurance, legal or compliance advice.
You're responsible for licensing and appointments, producer compliance, and each insurance carrier's rules. Features such as license-based call routing help with this, but they don't guarantee that a call reaches a properly licensed agent.
You decide which documents your clients may sign electronically through the Service. You're responsible for whether an electronic signature is valid and acceptable for each document, including any carrier or state requirement for a handwritten signature or a specific form.
The Service records each signing (who signed, when, and from what IP address and device) and adds a Certificate of Completion to the signed copy. We don't guarantee that a particular document will be accepted by a carrier, court or agency.
Paid plans (Pro, Pro Plus, Pro Max and Enterprise) are billed per seat, monthly or annually, in advance, and renew automatically until canceled. A seat is a team user who calls or texts; the workspace administrator is management-only and isn't a paid seat. Current prices and what each plan includes are on the Pricing page and shown before you pay. Enterprise pricing and terms are agreed separately.
Each paid seat includes text segments and call minutes every month, pooled across your workspace: Pro 1,000 of each, Pro Plus 1,500, and Pro Max 3,000. Included usage that isn't used doesn't carry over.
Texts and minutes beyond what's included cost $0.03 per text segment and $0.03 per minute, paid from prepaid credit. When your included usage runs out, we charge your payment method $100 as credit, and another $100 whenever the credit falls below $25. Unused credit carries over.
Your monthly limit, set in Billing ($100 unless an administrator changes it), is the most we'll charge for credit in a calendar month. Once it's reached and the credit is used up, texts and calls out pause until an administrator raises the limit or the month ends; calls in keep ringing. If a charge is declined, texts and calls out pause and calls in go to voicemail until it's paid. Calls to 911 and 933 are never paused. By using the Service, you authorize these charges.
Phone numbers cost $4 per month each. E-sign costs $15 per month, or $180 per year, per workspace.
Stripe processes payments. You authorize us and Stripe to charge your payment method for your plan, seats, add-ons and usage credit. Prices are in US dollars and don't include taxes; you're responsible for any taxes that apply.
We may change prices with at least 30 days' notice to your administrators. A new price applies from your next billing period.
You may cancel anytime in Billing. Your plan stays active until the end of the period you've paid for, and you won't be charged again. Fees are non-refundable except as required by law or at our discretion.
You keep ownership of the leads, notes, recordings, messages, documents and other data you or your team put into the Service ("Your Content").
You give us permission to host, process, transmit and display Your Content only to provide the Service to you, keep it secure, prevent abuse, and as the law requires. We may use aggregated information that doesn't identify you, your users or your contacts to run and improve the Service.
You're responsible for Your Content and for having the right to give it to us, including lead lists you buy or import and the consent records behind them.
We use reasonable administrative, technical and physical safeguards to protect Your Content, and we require the providers that help us run the Service to protect it too. Those providers are listed in our Privacy Policy.
If we learn of unauthorized access to Your Content, we'll notify you without undue delay and as the law requires, and we'll work with you on it. You're responsible for your users' credentials and for the security settings you choose, such as two-step login.
Insurance businesses often must oversee the service providers that handle their customers' information. We'll answer reasonable security questions to help you do that.
DailyTrackly supports platform and reseller use. Authorized platform administrators may create and manage downstream organizations and sign in as users within those organizations for support purposes. Such access is logged.
The Service, including its software, design, logos, and content (excluding Your Content), is owned by DailyTrackly or its licensors. You may not copy, modify, or create derivative works without permission. If you send us suggestions, we may use them without any obligation to you.
You may cancel your subscription or delete your workspace at any time. Access to paid features ends at the end of the paid period. We may suspend or terminate your access if you violate these Terms or don't pay.
After cancellation or termination, we may keep data for a reasonable period, and longer where the law, billing, security or a dispute requires it (such as records of who accepted these Terms), and then delete or de-identify it.
Amounts owed, sections 2C, 8, 9 and 10, and any other terms that by their nature should continue, survive the end of your account.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose. We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific requirements, or that any text or call will be delivered.
To the maximum extent permitted by law, DailyTrackly and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue or data, arising out of or related to the Service or these Terms.
Without limiting section 2C, DailyTrackly is not responsible or liable for calls, texts, or other outreach by you or users of your account to numbers on any Do Not Call list, or for TCPA, TSR, or state-law claims arising from that outreach.
Our total liability for all claims combined, arising out of or related to the Service or these Terms, shall not exceed the amount you paid us in the 12 months before the event giving rise to the first claim.
You agree to indemnify, defend, and hold DailyTrackly (and its owners, officers, directors, employees, contractors, and affiliates) harmless from claims, fines, penalties, losses and costs (including reasonable attorneys' fees) arising from: Your Content; your use of the Service; your violation of these Terms or the law; any call, text, recording or other outreach by you or users of your account, including automated and AI-written texts; contact lists you import; documents you send for signature; and the acts of anyone using your workspace. This includes claims that you contacted a number on a National or state Do Not Call list or violated the TCPA, TSR, a call-recording law, or a similar law, and is in addition to the indemnity in section 2C.
We'll tell you about a claim promptly, let you control its defense with counsel reasonably acceptable to us, and cooperate at your expense. You won't settle a claim in a way that admits fault for us or puts obligations on us without our written consent.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising out of or related to these Terms or the Service will be brought only in the state or federal courts located in Leon County, Florida, and both parties consent to those courts' jurisdiction. To the extent the law allows, each party waives the right to a jury trial.
We may update these Terms from time to time. When we make a material change, we'll update the date at the top and ask a workspace administrator to accept the new Terms in the app before continuing; we may also email administrators.
